SMALL CLAIMS COURT
The Small Claims Court is a court of right and wrong, evidence, procedures and what the court decides is just and fair under the law. If you wish to start a claim, there is a two-year window in which to do so. Once you serve your claim, the other party will need to respond within twenty days. A next step can be a settlement conference before a judge to narrow the issues and see if the parties can resolve the matter before going to court. If not resolved, you will prepare for your day in court. Small Claims Court hears matters concerning monies and the return property with a set limit of $25,000 not including costs, disbursements or interest.
The better prepared you are at each stage, the better your odds are of having the court decide in your favor. We will be prepared at each step of your case.
We can file a motion to have a judgment against you set aside if you were not properly served.
